Why a New Industry-Sponsored Fake News Section in the Denver Post Threatens the Newspaper’s Reputation

Even the most seasoned Denver Post readers can be fooled by a new advertising ploy from oil and gas front group Coloradans for Responsible Energy Development (CRED), in which fake, industry-sponsored news stories are being published as part of a special “Energy and Environment” section on the newspaper’s website.

Each CRED-authored story uses the same font and layout as real Denver Post articles from real Denver Post reporters, undoubtedly attempting to pass CRED’s message off as real news. But, it’s not. It’s yet another paid effort that CRED is using to validate its now-dwindling credibility. CRED is no stranger to promoting its message through paid advertising, as can be seen by the television, radio, online, and bus advertisements that the group has been running since its inception in September 2013.

This time, the ad on Denver Post’s website boasts “news” about oil and gas development in the state, when really, the group is just peddling its own version of facts. In the “Energy and Environment” section on the Denver Post’s website, CRED’s advertorial features several stories on natural gas exports, local control amendments, and other energy issues Coloradans have been following for months.

Amy Oliver, Independence Institute - Challenges Anyone to Find Six Oil & Gas Wells in Greeley, CO | Really?

Amy Oliver: 'There are over 400 wells in Greeley. I challenge people all of the time. Find me six. Name me where six of them are.' Referring to how hidden oil and gas wells are in Greeley. Oliver's statement from the ether was absolutely ridiculous. Did you think I couldn't find a single well Amy? You're sadly mistaken when it comes to grassroots organizations not having pertinent data and skill-sets. 
























Amy, here is the answer to your challenge. You said that Greeley has 400 oil and gas wells. Let me be the first to inform you that you are incorrect. You failed to count the abandoned wells under people homes, in backyards, near schools, playgrounds and more.

Let’s also not omit the more than one dozen toxic evaporation pits that have been back-filled and one location where a super market appears to have been built on top one. You challenged anyone to find ‘just six wells in Greeley, CO’ and I accept by offering up every well on record in Greeley.

Asthma takes toll on Basin residents - Oil and Gas Development

The just-released Asthma Burden Report for 2012 shows that 9 percent of adults and 7 percent of children have asthma in Utah.

Every day a statewide average of 20 people struggle with asthma attacks potentially so severe that they need treatment at a hospital.

What does this mean for the TriCounty Health Department regional residents of Daggett, Duchesne and Uintah counties?

Lost work days, lost school days, and lost lives –— the cost of asthma to our communities is cumulative.

On Thursday the TriCounty Asthma Coalition met to look into the report numbers in relation to local asthma treatment numbers.

Findings indicate that Uinta Basin asthma sufferers are twice as likely to be hospitalized; 57 basin residents per 10,000 people in population versus the state average 25 people.

Emergency numbers for children remain protected by law, but among school-aged children 41 percent cite asthma as the cause for missed school days.

Locally, children and adult asthma sufferers who go to the emergency room during an asthma attack are more likely to be admitted.

“The fact that our residents with asthma are going to the emergency department and being hospitalized so often means we need to mobilize our community partners and work together on this issue,” said Jeramie Tubbs, TriCounty spokesperson.

Educating the public about persistent risk factors says Tubbs is way to reduce asthma’s impact.

Risk factors like; adult sufferers are more often obese, while children with asthma are more likely to have parents who smoke.

Often lifetime sufferers are exposed to risk factors that are work-related like chemicals, dust, exhaust emissions, and smoke, according to the report.

The Uintah Basin is home to the largest oil and natural fields in the West and too, the basin Winter Ozone Study: a $5million scientific research analysis of reportedly some of the worst air quality in the U.S.

Preliminary findings of the study indicate a strong link between the extraction industry and air quality citing specific two things: “volatile organic compounds and nitrogen” says Joseph Shaffer, TriCounty director...

(Los Angeles, CA August 21, 2012)- Bringing together the voices of actors and celebrities such as Ed Begley Jr. and Raphael Sbarge with bloggers and online influencers, BloggersInspiringChange.org and ErieRising.com have created a PSA to help educate the public on exactly what fracking is and how it can harm their communities.

“Fracking is a method of natural gas extraction that has the potential to poison our families. However, few people even know it’s happening, and that means there is something wrong with this situation,” said Lee Allport, Creator of BloggersInspiringChange.org.



"I'm so happy to be a part of the initiative," said Raphael Sbarge, an actor and founder of the environmental awareness organization Green Wish. "Fracking is of great concern to those of us in the environmentalmovement, so it's so wonderful to take part in a grassroots effort led by many of those most directly affected by the practice. COGCC Claims West Hawk Energy (USA) Failed to abide by Rules: Fined $940k - Eight Wells Foreclosed

ORDER CALLING FINANCIAL ASSURANCE INSTRUMENT

The Commission heard this matter on December 12, 2011, at the Weld County Administration Building, 1150 O Street, Greeley, Colorado 80631 upon staff request for an order finding violation hearing against West Hawk Energy (USA) LLC authorizing a call or foreclosure of all remaining financial assurance instruments held on behalf of West Hawk.

FINDINGS

1.     On August 8, 2011, the Commission issued Order No. 1V-378 finding that West Hawk Energy (USA) LLC (“West Hawk”) (Operator #10189) had committed numerous rule violations at certain wells and imposed fines for those violations as compiled below:

2.  On September 19, 2011, the Commission issued Order No. 1V-385 pursuant to Docket No. 1100-OV-30, finding a pattern of violation against West Hawk, pursuant to Rule 525.b. for the rules violations for which West Hawk was fined under Order No. 1V-378 on August 8, 2011.

3. On October 7, 2011, Pursuant to Rule 522.c. and Rule 709, Commission staff filed a Notice of Hearing for an Order Finding Violation, calling or foreclosing the remaining $5,000 West Hawk financial assurance bond for purposes of assisting in the recovery of costs associated with the proper plugging and abandonment of the former West Hawk wells.  The matter was docketed for the Commission hearing on October 31, 2011.

                        4. On October 24, 2011, the COGCC was contacted by Gonzalo Torres Machiavello, former President and CEO of West Hawk.  On October 26, 2011, Mr. Machiavello met with COGCC staff and discussed the previous orders entered against West Hawk, and the current proceeding.  Mr. Machiavello stated that West Hawk Energy (USA) LLC has been dissolved and is no longer a going concern. This matter was continued at the request of West Hawk to the December 12-13, 2011 Commission hearing.

5.  Commission records reveal West Hawk has an active surety instrument with the Commission as follows:

6.     Rule 709 provides whenever an operator fails to fulfill any statutory obligation, and the Commission undertakes to expend funds to remedy the situation, the Director shall make application to the Commission for an order calling or foreclosing the operator's financial assurance.

7.  The Commission takes administrative notice of the rule violations for which West Hawk has been found liable under Order No. 1V-378 and Order No. 1V-385, and finds that such violations justify foreclosing  West Hawk’s financial assurance instrument pursuant to Rule 709.

8.  Staff has represented to the Commission that the proceeds from the West Hawk financial assurance instrument are needed to defray costs of properly plugging and abandoning the West Hawk Wells.

9.  On November 22, 2011, Gonzalo Torres Machiavello and his legal counsel met with Commission staff in a prehearing conference. At that time Mr. Machiavello offered his full cooperation and assistance in this matter.

                                                                                    ORDER

NOW, THEREFORE, IT IS ORDERED that the financial assurance instrument referenced above held on behalf of West Hawk, shall be called and foreclosed to the fullest extent allowed by law.

IT IS FURTHER ORDERED, that the proceeds from the calling of the West Hawk financial assurance instrument are authorized to be applied to cover costs of proper plugging and abandonment of the former West Hawk Wells.

IT IS FURTHER ORDERED, that under the State Administrative Procedure Act the Commission considers this order to be final agency action for purposes of judicial review within 30 days after the date this order is mailed by the Commission.

IT IS FURTHER ORDERED, that an application for reconsideration by the Commission of this order is not required prior to the filing for judicial review.

IT IS FURTHER ORDERED, that the provisions contained in the above order shall become effective forthwith.
                       
IT IS FURTHER ORDERED, that the Commission expressly reserves its right after notice and hearing, to alter, amend, or repeal any and/or all of the above orders.
