With now over 900 peer-reviewed studies showing harms of #fracking, will @EPAIreland study take these into account?


Unconventional gas exploration and extraction (UGEE) involves hydraulic fracturing (“fracking”) of low permeability rock to permit the extraction of natural gas on a commercial scale from unconventional sources, such as shale gas deposits, coal seams and tight sandstone. The UGEE Joint Research Programme (JRP) (www.ugeeresearch.ie) is composed of five interlinked projects and involves field studies (baseline monitoring of water and seismicity), as well as an extensive desk-based literature review of UGEE practices and regulations worldwide. The UGEE JRP was designed to provide the scientific basis that will assist regulators - in both Northern Ireland and Ireland - to make informed decisions about whether or not it is environmentally safe to permit UGEE projects/operations involving fracking. As well as research in Ireland, the UGEE URP looks at and collates evidence from other countries.
The JRP is funded by the Department of Communications, Climate Action and Environment, DCCAE (formerly the Department of Communications, Energy and Natural Resources (DCENR) and the Environment Division of the Department of Environment, Community and Local Government (DECLG)) and the Northern Ireland Environment Agency (NIEA). The research programme was managed by a steering committee comprising the EPA, representatives from DCCAE, the Geological Survey of Ireland, Commission for Energy Regulation, An Bord Pleanála, NIEA, the Geological Survey of Northern Ireland and the Health Service Executive.

Incredibly Poignant Comment from Audience Member Regarding Fracking Presentation

I gave my 'Inconvenient Proof - a state of failures'  presentation in Timnath, Colorado just two days ago with attorney, Dan Leftwich from www.MindDriveLegal.com.  The room was packed, a standing room only, with concerned citizens from the local area and a myriad of fracking industry workers.

I am always looking for the 'opposition' to heckle our meetings as they tend to do so with delight. I personally believe it's amateur at best, that the fracking industry attends our meetings to hand out their public relations garbage with a smile.  A lie with a smile is just a bigger lie. To our delight, there were no handouts of paperwork telling us that fracking fluids are 'found in our birthday cake', 'under our sinks', 'in our ice cream' and of course the morally reckless demonstration from Governor Hickenlooper drinking a citrus based fracking fluid sans the radioactive and carcinogenic chemicals.

After our Timnath presentations were completed I was approached by an audience member who told me that just prior to coming to our meeting he/she had a fracking industry at their doorstep telling them 'If you're going to see the anti-fracking presentation tonight,  it's all lies and you should know we have our own information and our side of the story that you must see too.'

First of all, it's clear the permitting frackers in Timnath are very nervous about us speaking the truth. The frackers send people knocking door-to-door in a feeble attempt to gain community support for their side of the story.  I guess if they are trying to sell the fracking snake oil myth, they gotta do what they gotta do right?

After Mr. Leftwich and I finished our presentations we felt that many people that were 'on the fracking fence' fell to one side. The side of truth and civil rights.  Here is a comment that one particular audience member left for us.  It's as precise as it gets, and a must read.

'First, let me remind everyone that I am not the spokesperson for the "Protecting Timnath" group, or last evenings' speakers. I'm happy to join them, I applaud their efforts, but am not trying to represent them, or take credit for their work. I hope this will be a respectful discussion, but I make no effort to be politically correct. I am a concerned citizen of this community.

I must say again, do your own research. I know this all sounds too impossible to be true, but unfortunately, it is all true. No one thought tobacco was harmful, or believed Erin Brockovich about the pollution by CG&E at first, either. Making snide remarks and insulting the messenger does not alter the facts. 

We were shown maps, pictures, and satellite images of pollution trails, page after page taken from the COGCC's own website of violations, complaints, rulings, letters and emails. This is all public information. It is not the wild ravings of some radical, tree hugging, extremist group, as some would have you believe. Colorado does not have the strongest regulations in the country. This is just the excuse the oil companies use to try to say fracking will be safe. 

Thanks to Dick Cheney, fracking is exempt from all clean air and water regulations. Does this sound safe to you? The very agency mandated with assuring that our health and safety are protected, COGCC, is acting as if it is an arm of the Colorado Gas and Oil Assoc., even allowing COGA to pursue overturning local fracking bans on behalf of the state. Seems unbelievable, right? Look it up. 

Ask local university scientists, biologists and geologists if this process could possibly be done safely. Read the COGCC rulings for yourself, research the communities where fracking has already taken place. Find out how many billions of gallons of water has already been used, which can never be cleaned or re-enter the cycle of use, evaporation, rain, use, etc. 

Learn about the cancer rate spikes in fracking areas. Drive though Weld County and observe storage tanks of toxic waste near playgrounds and in backyards. Read the scientific analysis of what that waste actually contains. If you want to know the position of the industry, simply turn on your TV. 

We are being bombarded with ads claiming how safe fracking is. No one disputes that jobs are created, and energy produced. The problem is the cost to our health, safety, and the environment. You have to ask yourself, do you want your family to be the canary in the coal mine? How many will have to be poisoned before it's finally considered unsafe?

I did a little research and went to this meeting thinking I probably didn't want fracking under our neighborhood elementary school and I certainly didn't want to deal with the noise and lights. I came home believing that fracking will be responsible for a public health and environmental disaster far beyond our current understanding.'

Approx. time of violation:  
 Public complaint # 200319674 alleged over application of weed control chemicals on 8/30/2011 caused adjacent landowner to be affected by fumes. In addition complainant alleged repeated application and uncontrolled runoff has caused vegetation kill extending beyond operator leased area since prior to 2008. 


Telephone conversation with complainant had concerns of mishandling of fracturing fluids on pad.


 Field inspection on 8/31/2011 found areas of soil kill extending beyond pad, uncontrolled storm water runoff and excessive weeds on location. Inspector also noted chemical (probable herbicide) smell present on pad.

Abatement or Corrective Action Required to be Performed by Operator
Provide history of herbicide application on the pad since 2008, to include all chemicals used, quantities and MSDS's and show weed control measures have been conducted in compliance with Colorado Noxious Weed Act. Provide history of all downhole well activities, to include frac jobs, well cleanings, well maintenance, etc. for a period of 7 years. Provide list of chemicals used, including quantities and MSDS's. 


Submit a Form 27 Site Assessment & Remediation Plan detailing a sampling and analysis plan (SAP) to assess potential soil impacts on the pad, at the point(s) of flow exit from the pad and onto the adjacent properties. Initial SAP needs to address soil sampling to include all COGCC Table 910-1 constituents, plus herbicides and chemicals identified in items 1 & 2. Upon COGCC approval, implement plan. Submit a copy of the Post-Construction Stormwater Program for this site to the COGCC for review and comment. Eliminate stormwater flow onto the adjacent property. Remove and control weeds. Provide and implement a weed control plan that eliminates spray and fumes from leaving pad.

 On December 5, 2011, a Form19 for a spill which occurred on 11/20/2011 included three background samples (reportedly not in the 11/20/2011 spill path) collected from the disturbed area of the pad. Two of the samples had arsenic levels of 25 mg/kg and 15 mg/kg. These arsenic concentrations are above the Table 910-1 level (0.39 mg/kg) and above background soil arsenic concentrations in Colorado for Native Grassland, Rangeland, or Agriculture of 3-14 mg/kg, according to the Colorado Department of Public Health and Environment (CDPHE) �Risk Management Guidance for Evaluating Arsenic Concentrations in Soil� (June 2010). The other background sample, not in the spill path, had an arsenic level of 5.5 mg/kg, indicating non-impacted material. The sample results indicate a previous spill on this pad which was not reported and was not remediated to meet Table 910-1 levels.

 1. Review operational history at pad to identify possible previous releases and potential sources of elevated arsenic. 2. The plan shall include a sampling program to delineate the vertical and horizontal extent of soil concentrations above Table 910-1 levels for full Table 910-1 constituents. 3. Provide written description and diagrams of surface geology and soils present at this location. 4. Perform a background study at this location. Background samples must be collected from undisturbed, native materials. 5. Prepare an interpretive report including the results of tasks 1 through 4 and the "background" samples reported for the 11/20/2011 spill. A one month extension has been granted from 1/20/2012 until 2/20/2012 on LSO 1/20/2012

THE WELL WAS SHUT IN AND THE WATER TANK WAS EMPTIED. THE PETROLEUM HYDROCARBON-IMPACTED SOIL IS BEING EXCAVATED. GROUNDWATER WAS ENCOUNTERED IN THE EXCAVATION AT ~8` BGS. BENZENE IMPACTS (630 UG/L) TO GROUNDWATER ABOVE THE CGWQS WERE CONFIRMED BY THE LAB ANALYTICAL REPORT.

Detailed Description:

DURING TANK BATTERY CONSTRUCTION, FIELD CREWS ENCOUNTERED PETROLEUM HYDROCARBON-IMPACTED SOIL UNDER THE WATER TANK. A LOOSE FITTING ON THE SIDE OF THE WATER TANK WAS IDENTIFIED AS THE SOURCE OF THE RELEASE. THE VOLUME OF THE RELEASE IS UNKNOWN.
